Terms of Service

These Terms of Service ("Terms") govern your use of the Mobile Traffic mobile application (the "App"), operated by Mobile AL Traffic ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The service
Mobile Traffic is an informational service that publishes local traffic reports — such as wrecks, closures, congestion, and construction — for the Mobile and Baldwin County, Alabama area. Reports are curated and posted by our operators and delivered to you as a feed, an interactive map, and push notifications.
2. No warranty on accuracy or availability
Traffic conditions change quickly. We do not guarantee that any report is accurate, complete, current, or delivered on time, and we do not guarantee that the App or its notifications will be available or uninterrupted. The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
3. Eligibility
You must be at least 13 years old, and old enough to form a binding contract in your jurisdiction, to use the App. By using the App you represent that you meet these requirements.
4. Subscriptions and billing
- The core feed, map, and area-wide alerts are free. A premium subscription removes the banner and unlocks location-specific alerts and quiet-time scheduling.
- Premium is offered as a monthly ($2.99/month) or yearly ($29.99/year) subscription, sold and billed through Google Play Billing. Prices may change with notice.
- Subscriptions renew automatically at the then-current price until canceled. You can manage or cancel your subscription at any time in the Google Play Store; cancellation takes effect at the end of the current billing period.
- Payments, renewals, and refunds are handled by Google under the Google Play Terms of Service and refund policy. We do not process payments directly.
5. Acceptable use
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms;
- Interfere with, disrupt, or attempt to gain unauthorized access to the App, our backend, or any related systems;
- Copy, scrape, resell, or redistribute reports or other content from the App without our permission;
- Reverse engineer or attempt to extract source code from the App, except where such restriction is prohibited by law.
6. Intellectual property
The App, its content, branding, and the "Mobile Traffic" name are owned by us or our licensors and are protected by applicable laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for its intended purpose. All rights not expressly granted are reserved.
7. Limitation of liability
To the fullest extent permitted by law, Mobile AL Traffic and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the App — including any reliance on the accuracy, timeliness, or availability of any report. To the extent liability cannot be excluded, our total liability for any claim relating to the App is limited to the greater of the amount you paid us in the twelve months before the claim or ten U.S. dollars ($10).
8. Third-party services
The App uses Google services (Firebase Cloud Messaging, Google Maps, and Google Play Billing). Your use of those services is subject to their respective terms and policies. We are not responsible for third-party services.
9. Changes to the App and these Terms
We may modify, suspend, or discontinue the App or any feature at any time. We may also update these Terms from time to time; when we do, we will revise the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
10. Termination
We may suspend or terminate your access to the App if you violate these Terms or misuse the service. You may stop using the App at any time by uninstalling it.
11. Governing law
These Terms are governed by the laws of the State of Alabama, United States, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the App will be subject to the exclusive jurisdiction of the state and federal courts located in Mobile County, Alabama, to the extent permitted by law.
